1. Scope of Application

These GTC apply to all services and content offered via nicos-ghosts.com. By using the website or commissioning services, you agree to these terms and conditions.

2. Description of Services

We offer creative services, in particular:

  • Photography

  • Videography

  • Music video production

  • Graphics and website editing and maintenance

The exact scope of services will be agreed upon individually in advance in writing (e.g., via email).

3. Conclusion of Contract

The presentation of services on the website does not constitute a legally binding offer, but rather a non-binding invitation to inquire. A contract is only concluded upon written confirmation of your inquiry (acceptance of the offer).

4. Prices and Payment

  • All prices are gross prices. Any expenses incurred (e.g., travel costs, material costs) will, of course, NOT be charged if a meeting is arranged at a convention, unless otherwise agreed.

  • Payment is made according to the individual agreement (e.g., by bank transfer, cash, Twint, or PayPal).

  • Unless otherwise agreed, payment or partial payment is due before the service is rendered (advance payment) or within 14 days of invoicing.

5. Appointments and Cancellations

  • Agreed-upon appointments are binding.

  • Free cancellation is possible up to 48 hours before the appointment. Cancellations are also possible up to 24 hours in advance. In exceptional cases, cancellations may be possible up to 2 hours before the appointment, but a reason must be provided.

  • For cancellations made with less notice or in the case of no-shows, a cancellation fee of 50% of the agreed fee may be charged. This fee may be waived after a discussion. However, this is not a guarantee or a gesture of goodwill on Nico's part.

6. Copyright and Usage Rights

  • The works created (photos, videos, music videos) are subject to copyright.

  • The customer receives a simple, non-transferable right of use for the agreed purpose (e.g., their own website, social media, private use).

  • Distribution to third parties or commercial use beyond the agreed purpose requires prior written consent.

  • The author (Nico) retains the right to use the works for self-promotion (portfolio, website, social media) unless otherwise agreed.

7. Liability

  • The provider is liable only for intent and gross negligence.

  • Liability for slight negligence is excluded, unless it involves injury to life, body, or health.

  • No guarantee is given for the availability of the website.

  • 8. Data Protection

The separate data protection policy of this website applies.

9. Final Provisions

Swiss law applies.

Should any provision of these Terms and Conditions be invalid, the remaining provisions shall remain unaffected.
